South Dakota is the only state that does not yet recognize CBD oil’s legality as a medical aid or legal product. Although the bill was passed to legalize hemp and its derivatives in 2022 it did not mention CBD oil.

It is another matter to use marijuana for recreational purposes. While marijuana has been legalized in some states, not all have legalized CBD oil for recreational use. Is it important to consider the source when deciding on legality of OCB oil?

We’ve already mentioned that some states have legalized marijuana for medical and recreational use. It’s fair to ask if CBD oil made from marijuana plants is legal. Well, once again, it depends. It is legal in some states like California and Colorado. In other states, Hawaii does not recognize it as legal product.

It is still illegal in many states to use marijuana-derived CBD oil. This means CBD oil that contains more than 0.3% THC. If you are interested in this product, make sure to do your research. Major US States Laws and Regulations

These are the guidelines for some major US states on the legality and use of CBD oil or other hemp derivatives.

* Arizona – CBD oil, and all other hemp-derived products containing less than 0.3% THC, are legal. Only licensed patients in states that can use marijuana-derived CBD oil are allowed.

* California – California is, along with Colorado, one of the most liberal states regarding cannabis products. All forms of CBD derivatives are legal in California, for medical and recreational use.

* Colorado – Colorado is the first state to legalize CBD. All forms of CBD derivatives, including oil are legal in Colorado for medical and recreational purposes.

* Florida – CBD oils containing less than 0.3% THC are legal for recreational and medical use in Florida.

* Hawaii – All hemp products, including CBD oil are legal in Hawaii. Patients with prescriptions may also be able to use CBD oil that has a higher THC content.

* Illinois – CBD oils containing less than 0.3% THC are legal in Illinois. They can be used for medical or recreational purposes.

* Iowa – CBD legal status is unclear in Iowa. Every compound found in cannabis plants is illegal. CBD oil must therefore be illegal. Iowans can still use CBD oil for medicinal purposes.

* Michigan – CBD oils containing less than 0.3% THC are legal in Michigan. They can be used for medical or recreational purposes.

* New Jersey – Both CBD oil derived from hemp and CBD oil derived from marijuana are legal in New Jersey. However, the former is only legal for medical use.

* New York – All hemp-derived products and marijuana-derived products in New York are legal.

* Texas – CBD oils containing less than 0.3% THC are legal in Michigan, for medical and recreational purposes.

* Washington – CBD oils containing less than 0.3% THC are legal in Michigan. They can be used for medical or recreational purposes.


Here it is. The laws regarding CBD oil in the United States are almost identical, with some exceptions. Although CBD oil is expected to be legal in all 50 states by 2022, we will have to wait to see.
